Terms of Service

1. Introduction

By accessing or using ApplianceAPI ("the Service"), operated at applianceapi.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms apply to all visitors, users, and subscribers who access or use the Service.

2. Description of Service

ApplianceAPI is an appliance data API that provides images, specifications, manuals, and serial number age decoding via REST endpoints. The Service is made available on a subscription basis and is intended for integration into third-party applications, websites, and business workflows.

3. Acceptable Use Policy

You agree not to:

• Scrape, redistribute, or resell raw data obtained from the Service
• Use the Service to build a competing product or dataset
• Reverse engineer, decompile, or disassemble any part of the Service
• Circumvent, disable, or otherwise interfere with rate limits or security features
• Use the Service for any unlawful purpose or in violation of any applicable laws
• Transmit malicious code, viruses, or any other harmful technology through the Service
• Attempt to gain unauthorized access to the Service, its servers, or any connected systems

4. API Usage & Rate Limiting

API usage is subject to rate limits and quotas as defined by your subscription plan. ApplianceAPI reserves the right to throttle or suspend access to any account that exceeds its allotted usage or engages in abusive request patterns. API keys may be revoked immediately and without notice if abuse is detected. Continued excessive usage beyond your plan's limits may result in additional charges or account suspension.

5. Accounts & Security

You are responsible for maintaining the confidentiality of your API key and account credentials. You must not share your API key with unauthorized third parties. You agree to notify ApplianceAPI immediately of any unauthorized use of your account or any other breach of security. ApplianceAPI will not be liable for any loss or damage arising from your failure to safeguard your account credentials.

6. Billing & Payments

Subscriptions are billed monthly through Stripe. By subscribing, you authorize ApplianceAPI to charge your payment method on a recurring basis. All fees are non-refundable, including partial months of service. ApplianceAPI reserves the right to change pricing at any time with at least 30 days' prior written notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing. Failure to pay may result in suspension or termination of your account.

7. Data Accuracy Disclaimer

Data provided through ApplianceAPI is aggregated from third-party sources and is not guaranteed to be accurate, complete, or current. ApplianceAPI makes no warranties or representations regarding the reliability of any data returned by the Service. You acknowledge that appliance specifications, images, manuals, and serial number decoding results may contain errors or omissions. You are solely responsible for verifying the accuracy of any data before relying on it for business or consumer-facing purposes.

8. Limitation of Liability

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. ApplianceAPI does not guarantee any specific uptime or availability. In no event shall ApplianceAPI, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service, regardless of the theory of liability.

9. Indemnification

You agree to indemnify, defend, and hold harmless ApplianceAPI and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

Either party may terminate the relationship at any time. You may cancel your subscription through your account dashboard or by contacting support. ApplianceAPI reserves the right to suspend or revoke your access immediately and without prior notice if you violate these Terms. Upon termination, your right to access the Service ceases immediately. Any provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to indemnification, limitation of liability, and governing law.

11. Changes to Terms

ApplianceAPI reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of New Mexico.
